And tobacco growers in North Carolina have been ordered to pay more of their H-2A workers’s transportation costs to the site, if including those costs lowers the workers’ first paycheck to below the applicable minimum wage.
“At this time, we’ve been advised by the American Farm Bureau Federation (legal counsel) not to pay those costs or any fines or penalties,” Ms. Futch said.
“This is not a regulation, there’s no law stipulating this.: so we’re questioning how the Department of Labor has the authority to enforce this.”
North Carolina growers were deliberately targeted, Ms. Futch said, because it was felt they might be more susceptible to pressure to drop the H-2A program because of all the other challenges tobacco growers face today.
