Commonwealth's Attorney Peter Luke had asked the judge to sentence Ms. Burke to the three months. He said, "This is not a woman who is before the judicial system for the first time." Mr. Luke added that Ms. Burke had previously been convicted of assault and battery and brandishing in Rappahannock County and had a prior firearm conviction in Culpeper.. The assault and battery and brandishing charges were all part of the same incident which brought her to Circuit Court on charges of grand larceny and possession of a firearm after having been convicted of a felony. "She has a lengthy record of criminal.violations and has never had to serve any time."

Mr. Gladstone argued that his client had only one felony conviction, for a bad check.

Ms. Burke will also be on two years' supervised probation upon her release from jail. Judge Robertson told her that as people move through the criminal justice system with more convictions, the harsher they are dealt with.
