Zoning administrator David Konick recommended last week that the Planning Commission endorse a request from Rev. John K. Burke for a special use permit and variance to setback and floodplain regulations necessary before the minister can expand his Gid Brown Bible Church to provide space for Sunday school.
The church on Route 622 is situated on a non-conforming lot in a floodplain. Under the county’s current zoning ordinance, structures in floodplain may not be expanded or enlarged. In addition, the church building does not conform to the ordinance in that it is located just 20 feet from side and rear property lines. Regulations further specify that non-conforming uses must comply with zoning laws if those uses are expanded or enlarged. Also the ordinance requires a special use permit for a church in an agricultural zone.
In reviewing the variance requests to be considered by the Board of Zoning Appeals, Konick advised the planners last Wednesday that, in his opinion, denial of Burke’s application would work an undue hardship and unreasonably restrict use of the property.
Rev. Burke had indicated that he intends to use a trailer to provide space for the Sunday school .classes. However, at an earlier Planning Commission meeting, Konick said he would explain to the minister that trailers are not permitted under Rappahannock’s zoning laws except in trailer parks or for temporary use while a permanent structure is being built.
