In execution of a certain deed of trust made by EARL M. BERRY, divorced and not remarried dated January 4, 1962, and recorded in the Clerk's Office of the Circuit Court of the County of Rappahannock, Virginia. in Deed Bock 140. page 553. default having been made, the undersigned Trustee, substitute by Deed of Appointment pursuant to the request of the holder of the Note thereby secured, will offer for sale at public auction the property briefly described as 41-1/2 acres knosm as the "Gray Tract" located in the Jackson Magisterial District Rappahannock County, Virginia.
Subject to conditions, restrictions. rights-of-way, easements and reservations in the chain of title to this property, and subject to any unpaid real estate taxes.
Said public auction to be held at the front door of the Rappahannock County Courthouse on April 6,1984 at 10:00 a.m.
TERMS: CASH. A bidder's deposit of $5,000.00 in the form of cash, certified or cashier's check may be required from any bidder, with settlement within thirty (30) days from the date of sale. Purchaser shall pay all costs of title examination, recording costs (excluding Grantor's Tax), and conveyancing which shall be by Special Warranty Deed. If the purchaser defaults.
