A failure to yield the right of way ease that resulted in an accident on Oe* tober 8 was decided by Judge John Alexander Tuesday in Genial District Court. Ernest Preston Derry berry was found guilty of failing to yield the right of way, and was fined $25 plus $20 costs.
The accident involved a Cadillac driven by Derry berry, and a motorcycle driven by William Lewis Aylor, Jr. and took place on Route 211 in front of an entrance to the Emporium. Testimony by Aylor and one witness, Philip \Harper, indicated that Derry berry turned his vehicle into the path of the motorcycle in an attempt to enter the Emporium parking lot
Aylor was thrown from the motorcycle, and suffered injuries to his leg and bruises. Derrybeiry testified that he had not seen the motorcycle until right before the collision. "When making a left hand turn, the driver has to ascertain first that it can be done in safety,” said Judge Alexander of the guilty verdict
