Appeal on horses
to be heard
A hearing must be held to determine the ownership of 36 neglected horses seized from a Marshall pasture in December, a Fauquier County Circuit Court judge ruled Monday.
The Security Bank and Trust Co., of Midwest City, Okla., and the North American Thoroughbred Association, of San Diego, Calif., both claim they own the horses.
But a lower court judge in Jan. 10 ordered humane officials to place the animals in adoptive homes. Dennis McCarty III, of Delaplane, was considered the owner because he managed the horses when they were seized.
But Circuit Court Judge W. Shore Robertson ruled the two companies were not notified about the hearing and were “deprived of their property interest.”
A hearing date has not been set.
