Bird and BZA member James Swindler opposed the condition that would require BZA approval of the final plans because they questioned the BZA’s authority to attach the condition to the permit. Kramer and Monahan maintained that the condition was necessary due to the wetness of the property and so that the neighbors can be assured that the building will be built in harmony with the area. After some discussion, the members agreed to change the word “approval” to “consultation” in the condition. All four of the special use permit findings were made unanimously, and the permit was issued.
