Mr. Reynolds reported Mr. Baumgardner said his client did not wish to comply with that request “at this time.”
Mr. Morehouse asked Mr. Reynolds to write to Mr. Baumgardner requesting that an amended plat be filed at council’s expense within 30 days, or council would file suit in Circuit Court for a “quiet title.”
Mr. Reynolds said that would be the cleanest way to deal with the problem. The other possible solution would be to survey the streets and file a plat showing the town’s title to the streets.
Council member Newbill Miller asked if the second method wouldn’t be “as effective and less confrontational.”
Mr. Reynolds agreed it would be “less confrontational,” but said he didn’t think it would be “as effective.”
The council voted to send the letter without specifying what action the council will take if Mrs. Eagle doesn’t file the amended plat. Mr. Miller voted against the motion to send the letter.
