Forest landowners, loggers, and anyone with forestry interests need to be aware of new legislation designed to protect water quality from excessive sedimentation during forestry operations.
This law gives the Department of Forestry the authority to stop all or part of the silvicultural activities on a site if it is determined that the operation is causing or is likely to cause, pollution from soil erosion or sediment deposition in any state water. In most cases operators will have a reasonable time to implement corrective measures before any Stop Work Order is issued, but if a severe water quality problem exists, an Order can be issued immediately. Failure to comply with any order under this law can result in court proceedings and fines not to exceed $5,000 per violation. ,
