The Amissville Volunteer Fire and Rescue Company (AVFRC) filed an appeal on Thursday August 4 to the Circuit Court of Rappahannock County for the reversal of a decision by the Board of Zoning Appeals (BZA).
The appeal is in response to the BZA decision of July 22, in which the BZA voted not to grant a variance on a parcel of land owned by the AVFRC, The variance would have allowed a potential buyer of the land to build a house on it, which is prohibited by the parcel's current zoning. In the appeal, the AVFRC stated that the BZA violated the procedures of Virginia's Zoning Ordinance by the manner in which they voted the variance down. The appeal goes on to state that the BZ^'s decision was a violation of the constitutional guarantees to equal protection, due process, and the right to property and requests, that the Circuit Court reverse the BZA decision and award the AVFRC $75,000 in compensatory damages.
