neighboring landowner James Paul. He said he was opposed to (1) losing his privacy and (2) the excessive dust raised by traffic going in and out, of the ballfield during summer months. At the very least, if the exception is approved, Paul said, the right-of-way should be widened to allow for trees to be planted to screen the ballfield from residences and preserve privacy and the athletic park should be closed at dark. “The night traffic in the summertime gets pretty bad,” Paul said, adding that Mr. Carter, another adjoining landowner, “can’t even open his windows, the dust is so bad.”
“The Ruritan Club is an awfully nice organization and an awfully good cause but I don’t see in the ordinance where we can do this, even if Mr. Paul and Mr. Carter are not damaged by it,” said Planning Commissioner Newbill Miller.
If the subdivision is approved, the deed on the parcel conveyed to the Ruritans should carry a restriction, prohibiting its use as a building lot, Konick interjected without that, he said, once the lot is created, the club could conceivably sell the land and a house could be built there.
