The backlog at the Virginia Supreme Court, he said, is in civil appeals. It takes the court an average of two-and-a-half years to render a decision in civil cases, he noted.
Del. Kenneth B. Rollins (R-32nd), who voted for the court last year, says he’ll oppose it this session.
He says he supported it in 1983 with the understanding that changes would be made this year—particularly to eliminate the automatic right of appeal from the state’s circuit courts to the appeals panel.
“Anybody can appeal,” he says of the automatic provision, “and when you do that (the appeals court is) going to be overburdened immediately.”
