For three weeks in July and August of 1962, Rappshannock jurors listened to arguments, sweltering in a steamy upstairs courtroom with window air condition' ere turned off so testimony could be heard.
Attorneys for Betty Pateologos maintained that Col. Holmes was mentally incapacitated when the will was executed, that Dr. Neilson had exercised undue influence on the colonel and that fraud was involved in the actual signing of the document. The jury rejected all three arguments, upholding the $1.8 million bequest to the naval commander.
In reviewing that decision on appeal by Paleologos, Virginia’s Supreme Court Justices found “no reversible error.”
