that the owner of land that has been subdivided into lots or parcels which adjoins land used for agricultural purposes cannot choose to allow his land to lie open. Owners of non-farm land have an absolute responsibility to build one-half the fence or to pay for one-half the fence if properly notified by their farmer-neighbor.

In the second situation, and the more likely, a division fence has already been built and used by adjoining landowners. When the fence gets in a poor state of repair, either landowner can give written notice to the other of his desire to repair the fence.
