"Hie first obvious problem is that it takes discretion away from judges," Rebeil said. “Judges currently can consider evidence of a person’s immigration status as part of the circumstances before granting bail”
There are concerns the bill might cause racial issues.
“We have already seen an explosion of racial profiling in the Latino community and I believe this will increase this even further," Rebeil said.
Gilbert’s bill passed the House of Delegates Feb. 6 in a 92-5 vote. Currently the bill is waiting review in the Senate Committee for Courts of Justice.
Another bill that touches on illegal immigration is one that would have made it a Class' 1 misdemeanor for an employer to hire an applicant without checking his or her eligibility for employment. The bill has been set aside by the Labor and Commerce Committee.
The chief patron, Del. C. Tbdd Gilbert (R-Woodstock) says he will most likely resubmit the tall during next year’s session.
“I am very concerned about the issue and I hope the federal government doesn't grant general amnesty to illegals in the meantime," Gilbert said.
