Since the latest ordinance was adopted the family subdivision section has already been amended once by a restriction to provide that only one such lot could be created per year.
This restriction was included following a case where a parcel was divided by the hefrs to an estate and then sold. The owner of one of the lots applied for three additional lots by family subdivision, thus using up all the lots allowed on the parcel, leaving the owner of the other lot without any family subdivision rights.
The latest amendments proposed would require that to qualify for family subdivision, the parcel must have been owned by the person wishing to create the additional lots for five years.
Another proposal would require that the person acquiring the lot by family subdivision keep the lot for at least two years before selling it. The planners voted to add to the proposed amendment a requirement that the deed to the lot contain this restriction on resale.
