The Rappahannock County Board of Supervisors on Monday authorized Commonwealth’s Attorney Peter Luke to issue a consent order to address an ongoing zoning violation by B&S Site Development on Seven Ponds Road in Amissville.
The company has been operating a contracting business in the residential area without a special-exception permit. B&S co-owner Mike Brown Jr. applied for the permit last winter, but the request was unanimously denied by the supervisors.
Luke will prepare the order that allows B&S’s owners seven days to agree to a set of conditions that seek to address neighbors’ concerns until the company can find another location for its operation.
Otherwise, the matter will be dealt with in civil or criminal action, County Administrator John McCarthy said.
McCarthy said the order prohibits B&S from the activities that neighbors have complained the most about, including the heavy equipment and lowboy that are on the site and the number of employees visiting the site.
“It addresses what we think is the most egregious,” McCarthy said.
The measure essentially forces the company’s owners to admit they are in violation, he said.
