Just about two weeks ago, representatives from the Virginia Department of Game and Inland Fisheries confiscated and euthanized three miniature deer owned by Robin and Monty Cross.
Documents filed in Fauquier County Circuit Court show that the deer were seized when a group of DGIF officers, including State Game Warden Matt Miller, executed a search warrant at the couple’s property on June 27.
Last week the couple said they have considered suing those responsible for the circumstances leading to the death of their pets. But for now, they said they would continue to argue their case in public.
“We spoke to an attorney in town who wants a $10,000 retainer because the state would be a co-defendant (in a lawsuit),” Monty Cross said on Thursday. “So we have that as an option.”
Cross said he and his wife could easily afford to pay the lawyer. If they do file suit, however, he said they would prefer to work with an attorney who wants to take the case based on principle.
“It is not a money issue,” Monty Cross stressed. “We’re waiting for a lawyer who calls us not because they’re looking for money, but because it’s the right thing to do and they really want to help.”
