While it s abundantly clear that Cross was in violation of an obscure, well intended, state statute, the fact that he made a good faith effort to comply by first seeking advice from the Fauquier Sheriff's Office should have been taken into account.
I use the word obscure, because apparently even the Sheriffs Office wasn’t aware of the statute.
This fact seems a bit odd to me, since both the Sheriffs Office and DGIF officers have overlapping jurisdictional authority, i.e. a Sheriffs Deputy has the authority to enforce a game violation, and a DGIF officer has general law enforcement authority to include issuing a traffic summons or executing a felony arrest.
Why then should we not expect both groups to be equally familiar with the laws and statutes of the state? Given this jurisdictional overlap, in the future 111 be especially careful when driving Fauquier County for fear that my vehicle will be confiscated and destroyed for a minor traffic violation.
