The controversial amendment prohibits the General Assembly from changing existing state laws that ban samesex marriages as well as prohibiting legislators from creating any other type of legal relationship that has the same benefits as a marriage, such as civil unions and common-law marriages. Supporters, including Attorney General Bob McDonnell, a Republican, argued that the ban is necessary to defend Virginia’s existing laws from the kinds of court challenges that have legalized same-sex marriages and civil unions in other states.
