The third count, that Sheriff Woodward’s comments were made “without fact and with malice . . . knowingly, willfully and maliciously,” and that Mrs. Cebula suffered public humiliation, emotional distress and economic loss, was the only one considered by the jury.
The suit alleged that Sheriff Woodward made the comments maliciously in order to bolster his case for building a kitchen at the jail in Washington. Mrs. Cebula asked for $150,000 in compensatory damages for the alleged slander, and another $150,000 in puntative damages as punishment for Sheriff Woodward.
