Commonwealth Attorney Peter Luke said there would be policy issued which the board would have to decide, and the county might need to get outside advice on the technical aspects of the issue.

“If they want to come in here, make them put it in for everyone," Col. Bingham said.

The board then moved on to capital improvements programming. Mr. McCarthy said he wanted to do an area study of the potential commercial zone and wanted to hire consultants rather than making use of a part-time planner shared with other jurisdictions in Planning District Nine.

"The Capital Improvements Plan, the area plan and the Comprehensive Plan all come together with conditional zoning. We can’t use proffer power until we have a CIP," he said.

"If the general commercial area on 211 never develops, fine, but if it does I want to be able to say here’s what you have to pay so the rest of us don’t have to pay for your profit,” Mr. McCarthy said.

After more debate - with Col. Bingham insisting the county didn’t have a comprehansive plan, the board voted to recommend to the Planning Commission that they begin work on a Capital Inprovement Plan (CIPl and to table consideration of hiring a part-time planner.
