In Virginia, Mr. Heddleston added, the state code allows wide latitude through the establishment of a “community standard.” Obscenity is defined by the statute as material which appeals to a purient interest in sex, which is an affront to contemporary sexual standards, and which is without redeeming social values.
Beyond that, he said, each community may set a standard which could be enforced by its Commonwealth’s Attorney in court, if necessary. Both Mr. Heddleston and Mr. Von Fange advocated the establishment of a group to explore the possibility of enacting a community standard to protect the residents of Rappahannock County against pornography.
“We are worried enough about Blue Plains sludge, and hazardous materials in the landfill, to pass ordinances controlling them," Mr. Heddleston pointed out. “Why shouldn’t we have an ordinance to protect us from this stuff which pollutes the minds of our kids?”
The action in Sperryville, Mr.' Heddleston said, “expresses an opinion I think is widely held in Rappahannock County — that we do want a community standard” for what is acceptable.
