“Actually this was a good system,” the county’s historians conclude. “Since there were no minimum requirements of age, knowledge, or training for appointment as a Justice, these men furnished a nucleus of experience for the conduct of business of a new county. The Justices made up for their lack of legal training by their business experience and by their good, hard, common sense. They were amateurs ruling by natural law, and their decisions were usually fair and right.”
And they did more than oversee the criminal justice system. According to the Johnsons’ book, their duties covered all aspects of county life, from issuing marriage licenses and ordering quarantines of both people and livestock to arranging apprenticeships for poor orphaned children and establishing rates at ferries and tool toll roads and charges at ordinaries and taverns.
