Also apparently concurring with the opponents’ position that a rezoning to residential would be contrary to the intent of the county’s zoning and subdivision ordinances and Comprehensive Plan, the board found that allowing the subdivision by special exception instead would answer that objection.
According to the resolution read by Mr. Baumgardner, strict enforcement of the ordinances would work an unnecessary and unlawful hardship on Mrs. Davis. The board stressed, however, that no further subdivision of the three lots would be permitted.
