“If the board doesn’t act, it will be sending a very bad message to those who want to subdivide land,” Mr. Konick argued. “You’ll be telling them that if they can fool the zoning administrator, if they can catch the zoning administrator on a bad day, there’s no remedy ... As the county gets more growth pressure, as there’s more and more burden on the zoning administrator, as regulations get more complicated, mistakes are going to be made ...”
“It’s up to this board to correct them,” Mr. Konick said, adding that passage of an ordinance vacating the disputed subdivision plat may make the Halls’ suit against the county moot.
“Mr. Konick has raised so many legal points that I think we need time to study this, to get legal advice,” said Supervisor Charles Estes, winning unanimous support for his motion to table indefinitely Mr. Konick’s request to forward the plat vacation to the Planning Commission.
