The initial estimate of the height Of the replacement tower was 180 feet, but subsequent analyses have indicated that a smaller tower would be acceptable, and both the town and the county are awaiting an updated request.

Town attorney Bennett reported that the Town's zoning ordinance, passed after the existing tower was emplaced, restricts the height of structures in the Tbwn to 45 feet. Though the ordinance recognizes "grandfathered" use, nonconforming use is acceptable "as long as it continues uninterrupted." The replacement of the existing tower with one significantly larger would not then be permitted under the existing ordinance, and would be allowed only through the adoption of a new ordinance by the Town Council.
