Mr. Forman noted that a similar arrangement approved for Henrico County established a precedent for this accommodation.
Resource International, an Ashland-based company, is currently drafting a closure plan which will include the design for the limited expansion. “I can’t say when that will be finished but it should be soon,” Mr. Forman said.
As to conditions, Rappahannock’s supervisors must first approve the expansion. “Secondly, they must have their own site ready by a certain date,” said Mr. Forman, adding that the expanded capacity will determine that deadline; when capacity runs out so will the time allotted to the supervisors for finding a new solid waste disposal site. “Which means no more dragging feet because the state will not bend any further,” Mr. Forman emphasized.
Should the existing landfill be closed and the county not have a new dump location, the matter will be handed over to the Virginia attorney general’s office, according to Mr. Forman.
He stressed that responsibility for providing a landfill rests by law with the supervisors. If the county has no landfill, “they will be violating state law,” he said. He predicted
