Because that money was not yet in hand, Commonwealth’s Attorney Peter Luke argued that he should not yet be released. Judge W. Shore Robertson agreed that Mr. Messick had violated the terms of his probation, including leaving the state of Virginia, but felt that Mr. Messick had indeed turned his life around and was sincere about the money being on its way from Federal Express.
In tears, Mr. Messick left the courtroom free of his obligations to Rappahannock County. He still faces a violation of probation charge in Orange County.
When the Clerk’s Office was contacted on Monday, the money had been received from Mr. Messick.
Judge Robertson signed orders to declare two county residents habitual offenders: Penny S. Montessi, 33, of Amissville, and Curtis Ray Nichols, 28, of Viewtown.
