Accordingly, Baumgardner petitioned the circuit court in November for that factual determination in a declaratory judgement proceeding. He named the Rappahannock News as a party respondent so that the paper would have '‘an appropriate forum within which to present (its) petition.”
A pre-trial conference was held in January and the declaratory judgement was set for hearing when the school board voted unanimously at a meeting in the latter part of the month to accept the low bid of Baughan Construction Company of .Luray to build the dual purpose structure.
