the Freedom of Information Act. Do you foresee any conflict between that responsibility and your responsibilities as county attorney to advise and represent local governing bodies? If a conflict involving FOI arises, which responsibility takes precedent? If called upon for advice, how will you interpret FOI exclusions—broadly or narrowly? Will you work to persuade governing bodies to follow the intent rather than the letter of the law?
“With respect to the first part of your question, the Code of Virginia enacted by the General Assembly provides that the commonwealth’s attorney shall also serve as county attorney in counties having a population of less than 35,000 people. It also provides that the Freedom of Information Act is to be enforced by the commonwealth’s attorney. Apparently, the General Assembly sees no conflict between the two jobs and neither do I.
