You may want to use the wall of the existing building as a party wall, but that wall may stand partly on your lot. To avoid future litigation, a formal party wall agreement is made between you and the owner of the existing building. The agreement, which should be recorded, specifically states that you can use that wall. By all means check with your attorney if party walls are in your future.
