“Act one way or the other, and' let whoever is unhappy take it to court, because I assure you that’s where this will end up,” Attorney David Konick told the supervisors at their meeting September 8 as they once again considered a requestfrom Oscar and Stella Lozano for an> exception to the county’s subdivisionregulations.
Citing pending and potential litigation, the board retired to executive session with Commonwealth’s Attorney Peter Luke and emerged two hours later to vote unanimous approval for the Lozanos’ request.
At issue is a 25.75-acre parcel sold to the Lozanos by Lindgren Land Inc. in 1978 as two 12-acre lots. Mr. Konick, attorney for adjoining landowners, Mr. and Mrs.
