Ivan Hall, has maintained ~ and neither the Lozanos nor the Supervisors have disagreed ~ that the lots were illegally approved by then-zoning administrator Evan McNear since (1) the two- lots were cut from a previously subdivided parcel and (2) the lots are served by a 30-foot right-of-way. (The zoning ordinance prohibits resubdivision and requires that lots less than 25 acres in size be served by a 50-foot right-of-way.)
With the Lozanos planning to sell their property as two lots, Mr. and Mrs. Hall petitioned the Board of Supervisors to vacate the subdivision plat and turn the 25 acres into a single parcel. In addition, they have taken their case to the Circuit Court, asking Judge Shore Robertson to overturn the subdivision.
