Douglas Baumgardner told the
BZA.
“I think you’re entitled to investigate more than the one point brought up by Mr. McCarthy,” argued Frank Reynolds, attorney representing the adjoining landowners, Mr. and Mrs. Henry Gorfein. “You can look into whether any of the conditions (of the special use permit) have been breached.”
Mr. McCarthy noted that he has made no findings — “either affirmative or negative” — on the Sharps’ compliance with other conditions of their special use permit. “I’m not going to start looking for problems. If someone wants to make a complaint, I’ll investigate .. . It’s always confidential in my office, but I want to hear the complaints before I investigate,” the zoning administrator said, looking towards the Gorfeins and their attorney. He noted that when the migrant housing was authorized, the zoning administrator then did not issue written permits but wrote any conditions attached by the BZA on the inside cover of the file folder for the application. Mr. McCarthy added that the court reporter’s transcript of the August, 1984, BZA meeting had only been received that morning so he had not yet found the time to review it for additional information.
