“We’ve heard three different legal opinions. I don’t know exactly what’s the best thing for the county to do,” said Supervisor Newbill Miller.
“I don’t think there’s any right answer,” agreed Supervisor Nelson Lane. “I don’t think I’m entitled to amend the zoning ordinance for the convenience of the moment,” he said, questioning whether it would be proper to allow a less than 25 acre lot on a 30-foot right-of-way. But on the other hand, he added, the Lozanos’ two lots may be entitled to approval as lots of record.
“You’re not being ■ asked to amend the subdivision ordinance,” explained Mr. Luke. He noted that the ordinance’s provision for granting exceptions is built in as “an escape hatch” for just that reason.
