Monday, granted the Lozanos exceptions to the subdivision ordinance requirements which the Halls alleged were violated, including a waiver of the referal to the Planning Commission for a recommendation.
Commonwealth’s Attorney Peter Luke, the board’s legal counsel, advised the Supervisors to consider the Lozanos’ application for subdivision ordinance exceptions “on its own merits, regardless of the pending court case.” The board must only determine if the application meets the standards set out in the ordinance for granting an exception, he added. “How close does it come?” Chairman Hubert Gilkey asked the zoning administrator.
