Calling it “a fact finding situation,” the Board of Zoning Appeals deferred action on a recommendation from Zoning Administrator John McCarthy that a special use permit for migrant worker housing be revoked.

Only three members of the BZA were present at last Wednesday’s meeting, prompting James Swindler to suggest the postponement until the BZA’s next session on September 24.

At issue is a permit for temporary migrant worker housing issued in August, 1984, to George and Sally Sharp for their 225 acre Mountain Green orchard and farm in Harris Hollow. Mr. McCarthy has recommended that the permit be revoked because subsequent family transfers of land have reduced the acreage specified in the permit. (One 30 acre parcel, deeded to Alexander and Roseanne Sharp, includes the migrant worker housing.)

The county Planning Commissioners found the permit to be still valid, in that the parcels were transfered to family members and that the operation continues unchanged as a family orchard and farm.

“My clients see the decision as fairly simple . . . narrow . . . whether the division of a 225 acre tract subsequent to the issuance of a special use permit, in and of itself gives cause for the revocation of that permit,”
