Judge Foley, however, said that he was not convinced that the law applied to Mrs. Coffey’s actions, and dismissed the charges against her.
In Coffey’s case, Judge Foley observed, “Your attorney has presented a very able argument on your behalf.” He then found Coffey guilty of the charge and fined him $250 and costs. Sisk had earlier pleaded guilty to the charge and was fined $50 plus costs.
Leonard Louis Alsberry, also accused of hunting within 100 yards of a state road and shooting from a vehicle, also contested the charges. He said that he was driving on Rt. 637 near Huntly when he stopped the truck to look at some horses near the road.
A passenger in the truck, Charles David Hobson, spotted the deer after the truck was stopped. Mr. Alsberry testified that he got out and walked around to the rear of the truck, because “It had a nice shape, a nice rack - I wanted to see it.”
