He added that “I told Mr. Hobson before I got out that I’m not going to hunt from the road.”

Mr. Hobson took the stand and testified that it was he who shot at the deer. “I said ‘Stop!’ and I shot at the deer. He got out before I shot.. . He didn’t do nothing but stop the vehicle.”

Mr. Luke questioned, “You shot and it just stood there - what happened next?”

“You ain’t a kiddin’ it just stood there,” Mr. Hobson replied. “I thought, ‘What a fool I was!’ ”

Mr. Luke agreed that the evidence indicated that Mr. Hobson actually shot at the deer, but argued that, as in Mrs. Coffey’s case, Mr. Alsberry had aided and abetted the crime by stopping the vehicle and allowing him to shoot.
