McQuillan was being tried for arson, break- J ing and entering with intent to commit larceny! and grand larceny. [
The Commonwealth presented new evidence I in the form of the second juvenile involved in the crime, who as yet has not been charged, and his I account and McQuillan’s differed on several key issues.
McQuillan had testified that he and another juvenile snuck out of McQuillan’s home about [ 2:30 a.m. on Sept. 7 and went for a walk. Hej
said the other juvenile told him the buildings atj the field were easy to break into and he had} done it before. |
They went to the field and kicked in the door of the concession building, McQuillan testified. They set a fire in the floor so they could see by using paper towels balled up and lighting them. \
They took candy and food items and placed! them in a bag. They then stomped out the fire: and went on to the equipment building and did. the same thing, he said. j
McQuillan said the other juvenile pulled1 down clothes and gloves and threw them onto the fire at which time he told McQuillan that: the fire would bum hotter that way.
They also stomped out the second fire, he; said, after taking pins and baseball caps from! the building, and left.
The second juvenile said they both decided; to go to the field to break into the buildings and that McQuillan had knowledge of the field and} buildings because he had played ball there. I
He said McQuillan took paper napkins and, lit the fires because they tried the lights and couldn’t get them to work. ;
They went from the first building, the concession building, to the second, the equipment! building, while the fire in the first was still lit. He said,' McQuillan went back to the concession building and picked up the burning paper napkins and brought them to the equipment building to start a fire and burnt his fingers doing so.
