Pursuant to the terms of a deed of trust (the"deed of trust") dated December 16, 1991, recorded December 18, 1991, Clerk’s Office, Circuit Court, Rappahannock County, Virginia, in Deed Book 189, page 220, the real estate described below (the "property”) will be offered for sale at public auction:
All that certain tract or parcel of land with improvements thereon lying and being situate in the Piedmont Magisterial District of the County of Rappahannock, Virginia containing 1.516 acres, by survey, with metes and bounds as shown on plat of survey made by William P. Gimbel L.S., dated Dec. 4 1991, a copy of which is filed in Plat Cabinet A, page 146 among land records of Rappenhannock County, Virginia.
The sale will take November 10, 1997 at 11:00a.m. EDST at the entrance to the circuit Court of Rappahannock County, Virginia, at 238 Gay Street, Washington, Virginia 22747.
TERMS: The purpose price in the form of immediately available funds shall be due and payable on the closing date. A deposit in the form of immediately available funds in the amount of 5% of the sales price may be required of the successful bidder at the time of sale. The substitute Trustee reserves the right to waive or modify the requirement with respest to the bidder's deposit. The successful bidder will be required to close within 30 days from the date of sale. Time will be of the essence as to the closing date and the payment of the purchase price.
The properly will be sold “AS IS" and will be conveyed by SPECIAL WARRANTY deed, subject to all rights, reservations , leases, covenants, conditions, easements and restrictions superior to the deed of trust as they may lawfully affect the property. This property will be sold subject to a superior first Deed of Trust lien made by J.C. Holland and Jackie Holland, to James W. Fletcher-Trustee, dated September 13, 1982, and recorded in September 16, 1982 in Deed Book 142 at page 473 among the land records of Rappahannock County, Virginia, securing the original amount of $17,500.00.
Neither the Substitute Trustee nor the holder of the note secured by the deed of trust will deliver possession of the property to the successful bidder.
The purchaser at the sale will be required to pay all closing cost except the Grantor's recording tax. Real estate taxes will be prorated as of the settlement date.
