quently, Commonwealths Attorney Douglas Baumgardner removed himself as prosecutor in the case on the grounds that he might be called as a material witness. (Baumgardner was subpeonaed to appear at one of two pre-trial hearings that were closed to the public and the press. In addition to the hearings, portions of the record in the case have been closed at the order of Judge Thomas Horne.)
Following Baumgardner’s removal, which was endorsed by the Virginia State Bar’s counsel, Steven Merrill, former assistant prosecutor for Fairfax County, was named special prosecutor.
