The matter of land use restrictions and controls with regard to real estate is quite interesting. Hundreds of years ago when private controls were usually in effect, property owners sometimes sold or gave away land with unusual and humorous restrictions. The seller might say that cows could only graze on the rear portion of the land! Or, he might specify that any building erected on the property and subsequently sold could only be sold to people who abstained from alcoholic beverages! The landmark year for subdivision restrictions was 1848, when developers could set up restrictions regarding types of homes that could be built on their lots.
