special prosecutor Steven Merrill confirmed by telephone on Tuesday that Kidwell will be tried again for the same offense. Asked where the trial will be conducted, he answered, “I don’t know, I don’t know.” He indicated that the case may be heard in Rappahannock but aaded that “someone may file a motion for a change of venue.” He noted, however, that an attempt to have the proceedings moved may well prove unsuccessful.
Questioned as to when the trial will be held, Merrill said that the different parties involved in the case had conflicts with various dates suggested for July and August. “It’s hard to find a date that’s convenient with everyone... It looks like it will have to be in Spetember.”
