Day represented the Town of Washington after a Flint Hill couple sued the town in 2003. The architectural review board and the town council denied their application to build a house at the edge of town, arguing that it did not fit in with the surrounding buildings. The couple took issue with the restrictions of the historic district ordinance and asked the court to declare them “invalid and unenforceable and void.” The town settled the suit in September 2004 and agreed to pay $75,000 to the couple.
