A letter from State Senator Kevin Miller of Harrisonburg was received by the council reminding council that the date to get a town charter bill passed for Washington is approaching. “Every municipality in Virginia has to have a corporate charter spelling out its specific powers, boundaries and name,” said Doug Baumgardner, legal counsel for the Town Council. “The charter has to be passed by the General Assembly, and by the governor.”
The Town of Washington’s charter has not been updated since 1894, and the deadline for sending the bill is coming up. ‘There’s a necessity for us to forward the charter bill on to our representatives in the State Senate and the House of Delegates, and then signed by the governor,” Baumgardner said. There also has to be a survey of the town done and included with the bill.
“We haven’t had this done since 1894, and because of Dillons rule it is important that we do so,” Baumgardner said. Dillons rule states that a locality can only exercise those powers conferred by the state. “We have to have in our charter bill all the powers that we need,” said Baumgardner.
